Terms of Service

1. Acceptance of Terms

By accessing or using BESTcyberIQ ("the Service"), operated by BESTulaba LLC ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

BESTcyberIQ provides a self-assessment platform based on the NIST Cybersecurity Framework 2.0 (NIST CSF 2.0). The Service generates maturity scores, prioritized recommendations, and PDF reports based on responses you provide.

3. Informational Purposes Only

THE SERVICE IS PROVIDED FOR INFORMATIONAL PURPOSES ONLY. BESTCYBERIQ ASSESSMENTS, SCORES, RECOMMENDATIONS, AND REPORTS DO NOT CONSTITUTE PROFESSIONAL CYBERSECURITY ADVICE, LEGAL ADVICE, COMPLIANCE CERTIFICATION, OR A GUARANTEE OF ANY KIND. RESULTS REFLECT YOUR SELF-REPORTED RESPONSES AND SHOULD NOT BE RELIED UPON AS A COMPREHENSIVE OR DEFINITIVE EVALUATION OF YOUR ORGANIZATION'S SECURITY POSTURE.

4. No Guarantee of Security

USE OF THIS SERVICE DOES NOT GUARANTEE THAT YOUR ORGANIZATION IS SECURE, COMPLIANT, OR PROTECTED FROM CYBERATTACKS, DATA BREACHES, OR OTHER SECURITY INCIDENTS. BESTCYBERIQ MAKES NO WARRANTY THAT ALL CYBERSECURITY RISKS OR THREATS WILL BE IDENTIFIED THROUGH USE OF THE ASSESSMENT. IMPROVING YOUR ASSESSMENT SCORE DOES NOT ENSURE THAT YOUR SYSTEMS ARE FREE FROM VULNERABILITIES OR THAT YOUR ORGANIZATION MEETS ANY SPECIFIC REGULATORY OR LEGAL REQUIREMENT.

5. No Liability for Security Incidents

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BESTULABA LLC SHALL NOT BE LIABLE FOR ANY DATA BREACH, CYBERATTACK, RANSOMWARE INCIDENT, REGULATORY FINE, OR OTHER SECURITY INCIDENT THAT OCCURS BEFORE, DURING, OR AFTER YOUR USE OF THE SERVICE, REGARDLESS OF WHETHER YOU FOLLOWED THE RECOMMENDATIONS PROVIDED BY BESTCYBERIQ.

6. Limitation of Liability

IN NO EVENT SHALL BESTULABA LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

7. Indemnification

You agree to indemnify, defend, and hold harmless BESTulaba LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of a third party.

8. Trial and Evaluation

Free tier and 14-day trial accounts are provided for evaluation purposes only. Warranty, availability, and support obligations do not apply to trial or evaluation access. BESTulaba LLC may revoke trial access at any time and for any reason. Users may not use the same trial for more than one evaluation period in any twelve-month period.

9. Plans, Billing, and Purchases

BESTcyberIQ offers the following account types:

Free: No payment required. Includes one assessment and limited recommendations.
Report ($499 per assessment): A one-time purchase providing one NIST CSF 2.0 assessment, an executive PDF report, top 10 recommendations, and 1-year access to your results. This is not a subscription. Additional reports may be purchased at any time at the same price. Each purchase provides one assessment credit; unused credits do not expire within your 1-year access window. No automatic renewal occurs.
Pro ($199.99/month or $1,999/year): A recurring subscription. Billed monthly or annually via Stripe. Annual plans renew automatically at the end of each 12-month period unless cancelled before the renewal date.
Team ($499/month): A recurring subscription for up to 25 organization members. Billed monthly via Stripe.
Enterprise ($1,499/month): A recurring subscription for unlimited organization members, including SAML SSO and advanced features. Billed monthly via Stripe.

Cancellation: Subscription tiers may be cancelled at any time through your account settings. Cancellation takes effect at the end of the current billing period; access continues until then.

Trial expiry: At the end of a 14-day trial period, your account reverts to the Free tier. No charge is applied and no data is deleted.

Refunds: We do not provide refunds for partial subscription billing periods except as required by applicable law. One-time Report purchases are non-refundable once an assessment has been completed or a PDF report has been generated.

Taxes: You are responsible for all applicable taxes arising from your use of the Service.

Payment processing: All payments are processed by Stripe. BESTcyberIQ does not store your payment card information.

10. Informational Purpose; No Insurance or Compliance Guarantee

BESTcyberIQ assessments, scores, recommendations, and reports are provided for informational and self-improvement purposes only. They do not constitute professional cybersecurity advice, legal advice, compliance certification, or a guarantee of security.

Use of this Service does not guarantee eligibility for, qualification for, or approval of any cyber insurance policy, nor does it guarantee a reduction in premiums or improvement in underwriting outcomes. BESTcyberIQ is not affiliated with any insurance carrier or broker and makes no representations regarding insurer requirements or standards.

Scores reflect your self-reported responses. Results should be reviewed and validated by qualified internal staff or external advisors before being used for compliance reporting, regulatory submissions, audit purposes, or insurance applications.

11. Service Modifications and Discontinuation

We reserve the right at any time to modify, suspend, or discontinue the Service or any portion thereof, with or without notice. You agree that BESTulaba LLC shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

12. Acceptable Use

You agree not to: (a) violate any applicable law or regulation; (b) submit false or misleading information; (c) attempt to gain unauthorized access to our systems; (d) resell or redistribute the Service without written permission; (e) use the Service to harm, defraud, or deceive others.

13. Intellectual Property

All content, software, and materials provided by BESTcyberIQ are the property of BESTulaba LLC or its licensors. Your assessment data and responses remain your property. By using the Service you grant us a limited license to process your data solely to provide the Service.

14. Privacy

Your use of the Service is governed by our Privacy Policy, incorporated herein by reference.

15. Survival

All provisions of these Terms which by their nature should survive termination — including but not limited to limitation of liability, indemnification, intellectual property, and governing law — shall survive termination or expiration of your account.

16. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or by posting a notice on the Service. Continued use after changes constitutes acceptance.

17. Governing Law

These Terms shall be governed by the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Middlesex County, Massachusetts.
